Adore Me Privacy Policy

INTRODUCTION

Adore Me, Inc. (“Adore Me”, “we”, or “us) knows that you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly. This Privacy Policy explains how we collect, protect, use and share information about you when you use the Adore Me website located at adoreme.com (the “Site”), the Adore Me mobile app (the “App”), the Adore Me mobile site (the “Mobile Site”) and related services (together with the Site, the App, the Mobile Site, and the Adore Me Content, as defined below, the “Services”).

We hope this information increases your confidence in Adore Me and enhances your experience with us.

Each time that you use the Services, this Privacy Policy applies. If you do not agree to the terms of this Privacy Policy, you must discontinue using the Site and the Services. We encourage you to review this Privacy Policy carefully and to regularly check for updates.

 1. INFORMATION/DATA WE COLLECT AND HOW WE USE IT

We collect data, including Personal Information, about our customers, members, visitors or users in two ways: (1) automatically from all visitors to the Site and from all individuals that use the Services (“Passive Data Collection”) and (2) directly from you, when you voluntarily submit information to us (“User-Submitted Information”). Our primary purpose in collecting Personal Information is to provide you with a safe, smooth, efficient, and customized experience. We only collect Personal Information about you that we consider necessary for achieving this purpose.

“Personal Information,” as that term is used in this Privacy Policy, is information that identifies, relates to, or could reasonably be linked with a particular individual or household.

 a. Passive Data Collection

We automatically track certain information based upon your use of the Site or the Services.

Log Files 

Like most websites, we automatically receive and record certain information about our users’ behavior on our Site and use of our Services. Our systems automatically gather technical information about our Site or App traffic and store it in log files. This information includes Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information to do internal research on our users’ demographics, interests and behavior to better understand, protect and serve you and our community.

Mobile Device Information

When you download or use our Adore Me mobile application (“App”), we receive information about your mobile device such as the device token as well as the device unique identifier. This data enables us to track unique downloads and we may use it to send you push notifications about your transactions or use of our Services.

Cookies

A cookie is a small text file that is stored on a user’s device for record-keeping or tracking purposes. 

We use the following categories of cookies on the Site and Mobile Site:

- Functional cookies (e.g., to determine the device you use to access the Site and format the Site accordingly, cookies necessary to select and purchase a product).

- Statistics cookies, which enable us to understand better how you interact with the Site and Services by collecting and reporting information anonymously.

- Marketing cookies used to display ads that are more relevant to you.

We also use authentication cookies on the App.

Cookies help us enhance your experience by speeding your navigation through the Services, recognizing you, and tracking your usage of the Site and Services.

You may remove certain cookies by following directions provided in your Internet browser’s "help" menu. You may also configure your browser to prevent cookies from being set on your computer; however, if you reject all cookies, your ability to use the Site and Services may be limited and you may not be able to use certain features of the Site.

This Privacy Policy covers the use of cookies by Adore Me only and does not cover the use of cookies by any advertisers or other third parties.

Pixels

We use pixels that help manage content on the Site by tracking what content is effective. They are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of users. We also track user events on the App for the same reasons.

We also use pixels in our HTML-based emails to know which emails recipients have opened. This allows us to gauge the effectiveness of certain communications and marketing campaigns.

 b. User-Submitted Information

Registration

In order to use the Site and the Services, you must first register with us and provide your email address. We use this information to contact you about the products and Services in which you have expressed interest and otherwise to communicate with you about Adore Me and our marketing partners, including special offers and updates, messages about the Services and Your Account.

In order to better tailor our Services to you, we may also ask for certain personal preferences or characteristics, such as your favored colors or padding type, cup size, top or bottom size, dress size, or even your birthday. This information is not mandatory and you may choose not to provide it.

Newsletter

Regardless of whether you register with us, we might collect your email address if you sign-up to receive our newsletter. You can control your email preferences or unsubscribe on your Adore Me account page.

Orders

If you order a product from us (from the App, Site or Mobile Site), we will request certain Personal Information from you on our order form including your name, shipping address, and telephone number. We do not collect, access, use or store any of your payment information. All cardholder data you may provide when completing a purchase on the Site or through the App is collected, stored and processed in a PCI-compliant manner by a third party provider (currently Stripe, Inc.).

Further, when you order an Adore Me gift card, we may require that you provide the recipient’s name, shipping address and email address.

We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you or the order’s recipient.

Surveys or Contests

If you choose to participate in a survey or contest available on our Site, Mobile Site or App, we will collect certain Personal Information from you, which typically includes contact and demographic information. We use this information to notify contest winners and award prizes, to monitor traffic, or to personalize our Services (in the case of anonymous information collected in surveys) and to send participants an email newsletter. By participating in a survey or contest you consent to its terms and conditions, and you may be asked to provide permission to share your Personal Information with sponsors of that survey and/or contest.

We may use a third party service provider to conduct these surveys or contests, in which case the third party service provider’s use of our users’ Personal Information will be governed by its privacy policy, which will be made available to users at the time they enroll for the survey or contest.

Refer-A-Friend

If you choose to use our referral service to tell a friend about our Services, we will ask you for your friend’s name and email address. We will automatically send your friend a one-time email inviting him or her to visit the Site. Adore Me collects your friend’s name and email address for the sole purpose of sending this one-time email and tracking the success of our referral program. We will make clear that our email to your friend was sent at your request. You should check that your friends consent to your sharing of their personal information before submitting it to us.

We will, at your request, send a follow up email to your friend if we have not heard from her/him within three days. If your friend does not wish to receive future invitations or emails from us, your friend may unsubscribe by following the link included on our email or contact our Customer Care department at Help@AdoreMe.com or at 1.800.433.2367 (Monday – Sunday 8:30 a.m. – 8:30 p.m. (EST)) to request that we remove her/his email address from our mailing list.

Third-Party Account Credentials

When you provide us with your third-party account credentials to such services as Facebook and Twitter, you understand some content and/or information in those accounts (e.g. your name, email address or account IDs) may be transmitted into your account with us. However, information transmitted to our Site from your third-party account will be covered by this Privacy Policy.

Chat Rooms/ Discussion Boards

If you choose to post messages in our chat rooms or other public message areas or leave feedback for other users, please note that such information is available to anyone with Internet access. We may, but are not obligated to, collect the information you post in our chat rooms or other public message areas to resolve disputes, provide customer support and troubleshoot problems as permitted by law. PLEASE BE CAREFUL WHEN DISCLOSING ANY INFORMATION IN CHAT ROOMS, DISCUSSION BOARDS AND OTHER PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION YOU PUBLICLY DISCLOSE. If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site, we may collect such information into a file specific to you. We reserve the right to terminate the accounts of visitors who use the Services in a manner that is inconsistent with our Terms and Conditions.

Customer support

When you reach out to our Customer Care team, including by email at Help@AdoreMe.com or privacy@adoreme.com, you may provide Personal Information. This information is collected and used solely for purposes of handling your claim or request and to manage our customer service efficiently. Please do not email your credit card number or other sensitive information to these email addresses. 

2. PURPOSE AND LEGAL BASIS FOR PROCESSING

 a. Purpose of processing

We collect, use, disclose or otherwise process your Personal Information for one or more of the following purposes:

· To fulfill the purpose for which you provided the information.

· To communicate with you, including via email, text message, push notification and/or telephone calls.

· To operate, maintain, and provide to you the features and functionality of the Service.

· To market to you, including through email, direct mail, phone or text message.

· To personalize your experience and to deliver custom content and product and service offerings relevant to your interests, including targeted offers and ads through our Services or third-party websites.

· To recognize you and remember your information when you return to our Site or Services.

· To help maintain the safety, security, and integrity of our Services, technology assets, and business.

· For testing, research, analysis, and product development, including to develop and improve our Services.

· To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.

· To protect Adore Me’s rights.

· To evaluate, negotiate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Adore Me’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Adore Me about consumers is among the assets transferred or is otherwise relevant to the evaluation, negotiation or conduct of the transaction.

 b. Legal basis for processing

Adore Me may process your Personal Information on the following legal grounds:

· Performance of a contract to which you are a party

· Adore Me’s legitimate interest

· Compliance with legal obligations

· Your consent 

3. DISCLOSURE OF PERSONAL INFORMATION

 a. Who do we share Personal Information with?

Adore Me may share Personal Information with third parties for business purposes or as required by law.

We may disclose your Personal Information to the following categories of third parties:

Adore Me Partners

Adore Me engages in marketing and promotional activities with carefully screened brands, or “Partners,” which we think will appeal to our user base.

Partners may be provided with non-identifying or aggregate information indicating the demographic information of users on our Site, buying behavior, and opportunities to market to select segments of our customer base indirectly. When we share aggregate user data, we do so in a way that it cannot be linked with a user’s Personal Information.

Service Providers

We may provide Personal Information to third parties for their use in performing internal business functions (e.g., mailing, maintenance, security, data analytics, email transmission or other messaging, order management, CRM, database management services, credit card payment processing or data hosting), or for performing client-facing services (e.g. delivery partners such as the U.S. Postal Service, United Parcel Service, and Federal Express) on our behalf. These service providers agree to only use your Personal Information in accordance with this Privacy Policy and for no other purpose than to provide the contracted-for services.

For example, we use a third-party software to verify your identity and address in order to ensure proper shipping and billing procedures for your purchases. The third-party software provider will only use your Personal Information in accordance with this Privacy Policy and for no other purpose than to provide us with the contracted-for services.

Related Parties

We may share some or all of your Personal Information with our affiliates (including a parent company, subsidiaries, joint venture partners or other companies that we control or that are under common control with us), in which case we will seek to require those affiliates to honor this Privacy Policy.

Third Party Advertisers

Adore Me uses third party advertising companies to help us further enhance our users’ experience and to better tailor our content to our individual customers. Third party advertising companies may collect Personal Information during your visits to this Site, our App, and other websites in order to provide advertisements about goods and services likely to be of greater interest to you. These companies typically use a cookie or third-party web beacon to collect this information.

Law enforcement and third parties pursuant to legal request

Adore Me may from time to time disclose Personal Information as it deems reasonably necessary to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations, in the United States and in other jurisdictions.

Others

We may also disclose Personal Information to third parties in the context of a corporate transaction, as reasonably necessary to evaluate, negotiate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Adore Me's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Adore Me about consumers is among the assets transferred or is otherwise relevant to the evaluation, negotiation or conduct of the transaction.

Links to Other Websites

The Services may contain links to other sites that are not owned or controlled by Adore Me, including sites that may use our branding. This Privacy Policy does not apply to those other websites. We encourage you to be aware of this when you leave the Site and to read the privacy policies and terms and conditions of each and every website you visit.

 b. International Transfer of Personal Information

Your Personal Information may be processed directly by us in the United States or in Europe, or by third parties as described above. As such, the Personal Information we collect from you may be transferred to, accessed in or stored outside the European Economic Area (EEA) or the United States. Wherever your Personal Information is stored, we will work to ensure that it is held securely and in line with applicable data protection regulation.

 c. “Do Not Track” or “Opt-out” options

California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how we respond to “Do Not Track” browser settings. Our Site is not at this time configured to read or respond to “do not track” settings or signals in your browser headers, which vary by browser provider, because a uniform technological standard has not yet been developed. We continue to review new technologies and may adopt a standard once one is created.

In lieu of a browser-based opt-out solution, you can utilize the Network Advertising Initiative approved methods for placement of “opt-out” cookies described here. Our Site and those of our third-party advertisers or other vendors are configured to read and honor these opt-out cookies, so long as they are present on your computer. Note that if you delete all cookies, you will need to reset your opt-out cookies for them to be read and honored. Specific instructions are available here. However, please be aware that we do not control these opt-out processes.

 d. No sale of Personal Information

Adore Me does not sell your Personal Information and will not sell personal information unless we provide you proper notice and, if appropriate, we obtain explicit consent. 

 4. RETENTION OF YOUR PERSONAL INFORMATION

We will retain both passively-collected and user-submitted Personal Information only as necessary to achieve the purpose for which it was collected, to the extent required by law (e.g. accounting, litigation hold) or to protect our business interests (e.g. bring or defend legal claims).

 5. CHOICE/OPT-OUT OF/UNSUBSCRIBE FROM COMMUNICATION

We may contact you directly by email using your registration email. We may also occasionally send you information about your account or our Services via text message. Please note that your carrier’s standard charges, data rates and other fees may apply. If you do not wish to receive SMS text messages from us, please adjust your preferences on our Site under “My Account” “Notifications” or contact Customer Care at 1.800.433.2367 (Monday – Sunday 8:30 a.m. – 8:30 p.m. (EST)) or by email at Help@AdoreMe.com.

If you download and use our App, and have enabled push notifications on your mobile device, we may send you alerts and notifications through push notifications to communicate with you, for example on the shipping status of goods you purchased. You can opt out of these messages by changing the settings on your mobile device.

Generally, if you wish to manage the frequency or alter the type of communication you receive from us, you may change your contact preferences at the “Notifications” tab of Your Account on www.adoreme.com at any time. If you require further assistance, please contact us by telephone at 1.800.433.2367 (Monday – Sunday 8:30 a.m. – 8:30 p.m. (EST)) or by email to our Customer Care department at Help@AdoreMe.com and our agents will assist you to change your account settings and/or deactivate your account.

6. OFFLINE COLLECTION, USE & DISCLOSURE OF INFORMATION

As you might expect, the majority of Personal Information Adore Me collects is obtained through our Site and the use of our Services. Nonetheless, this Privacy Policy applies to all Personal Information, whether it exists in electronic format or hard copy, online or offline.

7. SECURITY OF YOUR PERSONAL INFORMATION

The security of your Personal Information is important to us. Adore Me uses reasonable security measures to protect against the loss, unauthorized access, misuse, alteration and destruction of Personal Information under our control, both during the transmission and once we receive it. This includes, but is not limited to, the use of firewalls and encryption.

Our Site incorporates physical, electronic, and administrative procedures to safeguard the confidentiality of your Personal Information, including Transport Layer Security (“TLS”) for all financial transactions conducted through our Site, our App and our Mobile Site.  

It is your responsibility to make sure that your Personal Information is accurate and up to date, and that your password(s) and account registration information are secure and not shared with third-parties.

Although we make good faith efforts to maintain the security of Personal Information, no method of transmission over the Internet or method of electronic storage is 100% secure and we cannot guarantee that it will remain free from unauthorized access, use, disclosure, or alteration. Further, while we work hard to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent “hackers” or other unauthorized persons from illegally accessing or obtaining this information. To minimize the risk to you, we keep Personal Information no longer than necessary for legitimate business purposes or as required by law.

As part of securing Personal Information stored on our systems, we restrict access to Personal Information to Adore Me employees, contractors and agents who need to know that information in order to operate, develop or improve the Services. These individuals are bound by strict confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

If a security systems breach occurs and Personal Information is compromised, we may post a notice on our homepage (www.adoreme.com) or elsewhere on the Site and take any other appropriate step. If your Personal Information is impacted, we may contact you individually, in compliance with applicable laws. 

 8. CHANGES OF OWNERSHIP

In the event of a change in ownership, or a merger with, acquisition by, or transfer or sale of all or a portion of our assets to, another entity, we reserve the right to transfer all of your Personal Information to that entity. In these circumstances, the receiving entity would be bound by standards at least as protective of your privacy as the ones described in this Privacy Policy.

9. CHILDREN

The Children’s Online Privacy Protection Act (“COPPA”) protects the online privacy of children under 13 years of age. Adore Me Services are not directed toward individuals under the age of thirteen (13). We do not knowingly collect or maintain Personal Information from anyone under the age of 13, unless or except as permitted by law. If we learn that Personal Information has been collected from a user under 13 years of age on or through the Site, we will take the appropriate steps to cause this information to be deleted.

If you are the parent or legal guardian of a child under 13 who has registered on the Site or you believe has otherwise provided Personal Information to Adore Me, please contact Adore Me at Legal@AdoreMe.com to have that child’s account terminated and information deleted. 

 10. PRIVACY RIGHTS

As a California resident or a resident of the European Economic Area, you have the following rights in relation to the Personal Information about you that we have collected (subject to certain limitations pursuant to applicable law):

  Right to Know

You have a right to be informed about the categories of Personal Information we collect about you and how we use it. The purpose of this Privacy Policy is to provide you with relevant information.

 Right to Accurate and Complete Personal Information

You have a right to request that we rectify or complete inaccurate Personal Information we have about you.

You may edit or update certain Personal Information directly on our Site in your “My Account” page under “Personal Information”.

 Right to Access

You have the right, in certain circumstances, to request access to the specific pieces of Personal Information we have collected about you. To the extent possible, this data should be provided in a portable and machine-readable format.

 Right to Request Deletion

You have the right, in certain circumstances, to request the deletion of your Personal Information.

Right to Opt Out

Adore Me does not currently sell your Personal Information. If this changes, you will have the right to direct us not to sell Personal Information we collect about you to third parties.

In limited circumstances, you may also have a right to opt-out of, limit or object to the processing of your Personal Information.

“Shine the Light”

In addition to the rights described above, California’s “Shine the Light” law (Civil Code Section §1798.83) permits California residents that have an established business relationship with us to request certain information regarding our disclosure of certain types of Personal Information to third parties for their direct marketing purposes during the immediately preceding calendar year.

You may not be discriminated against for exercising any of the rights listed above.

Note that we will need to verify your identity before processing any request, which may require us to request additional Personal Information from you. We will only use this newly collected Personal Information in connection with the processing of your request.

If you are a resident of the EEA and you believe your rights are being infringed upon by Adore Me, you may also lodge a complaint with the competent supervisory authority.

This Privacy Policy will be updated annually. In addition, we may change this Privacy Policy from time to time. If we make any material changes to our Privacy Policy or how we handle your Personal Information, or we are going to use any Personal Information in a manner that is materially different from that stated in our Privacy Policy at the time we collected such information, we will give you reasonable and appropriate notice regarding the change.
